1. The service

Performance Intelligence provides performance management tools for companies: organization and position management, evaluation cycles, peer feedback, scoring, and an AI assistant. By creating an account or using Performance Intelligence you agree to these terms. If you use Performance Intelligencethrough your employer's workspace, your employer's agreement with us also applies to that workspace.

2. Accounts

You must provide accurate information and keep your credentials confidential. You are responsible for activity under your account. We may suspend accounts that compromise the security or integrity of the service.

3. Your company's data

Companies own the data they create in their workspace: evaluations, feedback, scores, and organizational structure. We process it only to provide the service, as described in the Privacy Policy. Who within a company can see what is controlled by that company's administrators through the permission system.

4. AI assistant

The AI assistant generates answers from your company's data and general knowledge. AI output can be inaccurate or incomplete, so review it before relying on it, especially for decisions that affect people. The assistant is included during the free trial and on the AI plan. Use of the assistant draws on a per-user token allowance; we may adjust allowances and fair-use limits to keep the service sustainable, and will communicate material changes. The questions you ask are logged to improve the assistant (replies are not stored).

5. Plans, trials, and billing

Performance Intelligence has two paid plans, Core and AI, priced per active member of your workspace and billed monthly or yearly. Current prices are on our homepage. Payments are processed by Stripe. Your card details go to Stripe directly and are never seen or stored by Performance Intelligence. When members join or leave, the billed seat count follows automatically and the difference is prorated.

Every new workspace starts with a free trial of the full product, including the AI assistant. No card is needed to start. If the trial ends without a subscription, the workspace becomes read-only: your data stays in place and you can subscribe at any time to pick up where you left off.

You can change plans or cancel at any time from the billing portal. Plan changes are prorated, and you see the amount before confirming. Cancellation takes effect at the end of the period you have paid for: you keep full access until then and are not charged again. Once a subscription ends, writing is restricted: your data stays readable and exportable for at least 30 days, and subscribing again restores full access. We never delete your data because a subscription ended: administrators can still request an export, and account deletion works as described in section 9.

If a payment fails, nothing is cut off immediately: the workspace stays fully usable while the payment is retried. If it stays unpaid, the workspace becomes read-only until payment resumes. Missed payments never delete data. If you believe a charge is wrong, contact us and we will look at it individually.

6. Acceptable use

Don't misuse the service: no unauthorized access attempts, no probing or disrupting the infrastructure, no using the platform to harass others, and no uploading content you have no right to use. Evaluation tools must be used in compliance with employment law applicable to your company.

7. Availability and changes

Performance Intelligenceis provided "as is". We work to keep it fast and available but do not guarantee uninterrupted service, and we may add, change, or remove features. We will not materially reduce the core service your company relies on without reasonable notice.

8. Liability

To the maximum extent permitted by law, Performance Intelligence is not liable for indirect or consequential damages, loss of profits, or loss of data arising from use of the service. Nothing in these terms limits liability that cannot lawfully be limited.

9. Termination

You may stop using Performance Intelligence and request account deletion at any time. We may terminate or suspend access for material breach of these terms. Upon workspace termination, company administrators may request an export of their data before deletion.

10. Governing law

These terms are governed by the laws of the jurisdiction in which Performance Intelligence's operator is established, without regard to conflict-of-law rules.
